What happens after I file my Answer?
After you file your Answer, the lender may ask the court to make a decision by filing a Motion for Summary Judgment and there will be a hearing. If your answer did not raise legal defenses, the lender will likely win.
If the judge does not think you had legal defenses, the court will enter a Final Judgment of Foreclosure.
If the judge denies the lender’s motion for summary judgment, you will go on to "discovery." Discovery is when each party gets to submit or request information to support their side. After discovery, the case will go to trial if it has not settled through loss mitigation.
If you lose at trial, the court will enter a Final Judgment of Foreclosure against you.
